1. IDENTIFICATION

The websitewww.scratchjrtactile.org (hereinafter the “Website”) is owned by Sistema THEAD, SCCL, (hereinafter “Scratch Jr Tactile”) domiciled at Calle Junta de Comerç, n. 20, principal - 08001, Barcelona (SPAIN) with NIF F72853450.

The registration and use of the Website grants whoever is carrying out these actions the condition of "User", being subject to the provisions of the "Legal Texts", including theLegal warning,Privacy Policy,Cookies policy and these Terms and Conditions. The User declares to have read and agrees with the Legal Texts, otherwise refraining from using the Website.

Any issue that is not expressly provided for in these Terms and Conditions shall be understood to be reserved to Scratch Jr Tactile, without prejudice to the application of the provisions of current regulations. Likewise, Scratch Jr Tactile reserves the right to carry out modifications and/or updates of these Terms and Conditions, of which the User will be previously informed for their acceptance or rejection in case they are substantial. In any case, it will be considered that the User expressly accepts said modifications or updates if they use the services offered by Scratch Jr Tactile on the Website again. 


2. DESCRIPTION OF THE WEBSITE

Scratch Jr Tactile makes the Website available to Users, through which Users are provided with access to 3D and 2D designs that correspond to a tangible educational resource and to educational and didactic resources to bring creative programming and thinking closer together. computing to all boys and girls, regardless of their different abilities and conditions (hereinafter, the "Materials"). 

Said Educational Materials are based on a kit with the designs and creative philosophy of ScratchJr, the version of Scratch for the little ones, in order to facilitate an inclusive development of the skills necessary for today's society, such as digital skills, critical thinking, problem solving and teamwork from the game.

Likewise, the Website makes available to the User a community through which Users who have created an account can provide comments, proposals, designs and/or their own projects, among others, so that the User can participate in both the creation and evolution of educational material, as well as the contribution to the philosophy and activities of the community itself.

 

3. USER ACCOUNT

The use of the Website is free for the User, but, in order to use some of the functionalities of the Website (such as downloading the designs, providing comments, improvements and/or rectifications of the Materials), the User must register as member of the Scratch Jr Tactile community from the creation of his own account. The creation of said account is optional, but it will be necessary to be able to participate in the Scratch Jr Tactile community. 

In order to create an account at Scratch Jr Tactile, the User must be of legal age and have the legal capacity to be bound by the following Terms and Conditions.  During the registration process, the user must provide the following information fields: Name, surname, position or title, email, country and city of residence, additional data provided by the User. For more information on the processing of the User's personal data, see ourPrivacy Policy. 

Registration for the creation of an account in the Scratch Jr Tactile community will be considered complete once the User has received a registration confirmation email.

The User must ensure the confidentiality of his access password and security of his account, and must notify Scratch Jr Tactile of any suspicion of loss, theft or compromise of the security of his account or access password. The User will be solely responsible for all access and use of the Website made from their user account by any person using their account, regardless of whether the access and use of their account is authorized by the User. The User's account is personal, unique and non-transferable.

The User ensures that the information provided to register is true, faithful, exact and complete and undertakes to update the information when it is incorrect or incomplete. In the event that the User provides incorrect or out-of-date information, Scratch Jr Tactile reserves the right to terminate the User immediately.

The fact of completing all the steps and providing the corresponding consent or acceptance implies the express acceptance of these Terms and Conditions by the User.


4. RULES OF USE OF THE WEBSITE

The User will be responsible for accessing, browsing or using the Website in accordance with these legal texts as well as in accordance with current legislation.

The Scratch Jr Tactile Team supports freedom of expression. However, the Website is intended for a broad audience and some of the content is inappropriate for the Scratch Jr Tactile community. You may not use the Scratch Jr Tactile service in any manner, which:

  1. Use the Website for illicit and/or illegitimate purposes; or illegally.

  2. Use the Website to the detriment of the Scratch Jr Tactile mission.

  3. Use the Website in order to cause damage, inefficiencies, interruptions, saturation, or similar defects in the functionality of the Website; 

  4. Convey malware, viruses or similar programs

  5. Promote intolerance, discrimination, hatred or violence against any individual or group;

  6. Threaten, harass or intimidate any other person, whether or not that person is a Scratch Jr Tactile user;

  7. Contains obscene language or personal attacks;

  8. Contains sexually explicit or graphically violent material;

  9. Provide instructions on how to commit illegal activities or obtain illegal products;

  10. Exposes the personally identifiable information, contact information or passwords of any other person without that person's permission.

  11. Breaking the security measures established by Scratch Jr Tactile;

  12. Impersonate, imitate or pretend to be another person when using the Services.

  13. Use the Website for advertising purposes, such as sending spam or other similar ways;  

  14. Disrespecting other users or discriminating against them for any reason, or breaching theScratch Community Guidelines.

The User undertakes not to use the Website in accordance with the above assumptions, as well as not to breach any of the provisions of these Terms and Conditions. If the User fails to comply with the rules of use of the Website, Scratch Jr Tactile reserves the right to adopt the measures it deems appropriate under the Law, as well as the expulsion or prohibition of access of the User.

 

5. RESPONSIBILITIES AND GUARANTEES

Scratch Jr Tactile has made every effort to ensure that the information on the Website is accurate and up-to-date. However, it does not guarantee nor is it responsible for the accuracy and updating of the contents of the Website. Likewise, Scratch Jr Tactile is not responsible for any error or omission in the contents of the Website and reserves the right to modify said contents at any time and without prior notice.  

The relationship between Scratch Jr Tactile and the User is governed by the Scratch Jr Tactile Terms and Conditions and/or by other general conditions or specific agreements. The contents of the Website do not prevail over said Terms and Conditions and Users cannot condition the commercial policy that Scratch Jr Tactile decides to adopt at any time. 

Scratch Jr Tactile is not responsible for errors or failures in the operation of the Website, whether intrinsic or due to the characteristics and limitations of the Internet. The User assumes any risk derived from the use of the Internet, including the possible transmission of computer viruses. Scratch Jr Tactile does not guarantee the uninterrupted operation of the Website services and will not be responsible for any damages that may arise from the interruption of the services. In particular, Scratch Jr Tactile will not be responsible in circumstances of force majeure such as fires, strikes and power cuts or any other unforeseeable or unavoidable events.

Scratch Jr Tactile encourages everyone to foster creativity by freely sharing designs, art, images, videos, code, and other work. However, we also understand the need for individuals and businesses to protect their intellectual property rights. You are responsible for ensuring that you have the necessary rights, licenses, or permissions to any User Generated Content that you submit to Scratch Jr Tactile.

All user-generated content you submit to Scratch Jr Tactile is licensed to and through Scratch Jr Tactile under the Creative Commons Attribution-ShareAlike 2.0 License. This allows others to view and remix (copy and modify) your content. This license also allows the Scratch Jr Tactile team to display, distribute and reproduce your content on the Scratch Jr Tactile website, through social media channels and elsewhere. If you do not wish to license your content under this license, please do not share it on Scratch Jr Tactile.

Although the Scratch Jr Tactile team requires all users to comply with these Terms of Use, some inappropriate user-generated content may be submitted and displayed on the Scratch Jr Tactile website. You understand that when you use Scratch Jr Tactile you may be exposed to User Generated Content that you find objectionable or offensive. In addition to reviewing reported user-generated content, the Scratch Jr Tactile Team reserves the right, but is not obligated, to monitor all uses of the Scratch Jr Tactile service. All User Generated Content is provided as is. The Scratch Jr Tactile Team does not warrant the accuracy or reliability of any user-generated content available through Scratch Jr Tactile. The Scratch Jr Tactile Team does not endorse any point of view, opinion or advice expressed in the User Generated Content. You agree to hold Team Scratch Jr Tactile harmless from any and all liability arising from User Generated Content and any Scratch Jr Tactile Day events that you may promote or host.

7. LICENSES AND CONTENTS OF SCRATCH JR TACTILE

Except for any user-generated content, Scratch Jr Tactile owns and retains all rights to Scratch Jr Tactile, the designs, functionality and architecture or any other content provided through Scratch Jr Tactile. If you wish to use Scratch Jr Tactile in a manner not permitted by these Terms of Use, you must first contact Scratch Jr Tactile. Except for the rights expressly granted under these Terms of Use, you are not granted any right to any Scratch intellectual property.

Scratch Jr Tactile provides supporting materials, including images, videos, and sample layouts, to help users create projects. Supporting materials are licensed under the Creative Commons Attribution-ShareAlike 2.0 license. You may also use Scratch Jr Tactile screenshots under the same license. Please note that this does not apply to materials that are also trademarks of Scratch Jr Tactile or other parties, as described below. The Creative Commons Attribution-ShareAlike 2.0 license requires you to attribute any material you use to the original author. When using Scratch Jr Tactile supporting materials or screenshots from the Scratch Jr Tactile website, please use the following attribution: “Scratch Jr Tactile has been created through a collaboration between THEAD System and the Scratch Foundation. consultwww.scratchjrtactile.org”.

The 3D and 2D designs of the blocks, boards and main characters are available for download and are subject to the copyright notice as indicated on the page ofScratch Jr Tactile FAQ.

The Scratch Jr Tactile name and the Scratch Jr Tactile logo are trademarks owned by the Scratch Foundation. Unless you have licensed Scratch Jr Tactile under a specific license agreement or program, you may not use these logos to label, promote, or endorse any product or service. You may use the Scratch Jr Tactile logo to refer to the Scratch Jr Tactile website and tangible programming environment.

The Scratch Jr Tactile Media Library may contain images and designs that are trademarks of third parties. The fact that the materials are included in the Scratch Jr Tactile support materials library does not in any way limit or reduce any intellectual property rights, including trademark rights, that would otherwise be available to the owners of the materials. materials. If you are a Scratch user and believe that your content did not infringe copyright and was removed in error, you can send a notification toinfo@scratchjrtactile.org. Please include:

  • Your name and Scratch Jr Tactile email address;

  • The specific content that you believe was removed in error; and

  • A brief statement of why you believe there was no copyright infringement (for example, the content was not copyrighted, you had permission to use the content, or your use of the content was "fair use").


 

7. LINKS TO THIRD PARTIES

The Website may contain links to other web pages in order to complement the services offered to the user. Scratch Jr Tactile is not the owner of said web pages, therefore it is not responsible for their contents or for any damages that the use of them may cause to the user.

If the user of the Website accesses said web pages and the services they offer, Scratch Jr Tactile will remain outside any kind of relationship that could be established between the User and the owners of said web pages or any third parties related to them.

Likewise, the owner of a web page in which it is intended to insert a link to the Website must obtain, in advance, authorization from Scratch Jr Tactile.

Scratch Jr Tactile will not be responsible for the contents of those web pages where there is a link to the Website and will remain unrelated to the relationships that could be established between the owners of the same and the users of the Website.

11. COMMUNICATIONS 

Scratch Jr Tactile may communicate with the User via email and/or phone calls provided that the User has given consent when legally required. These communications may be sent or initiated by Scratch Jr Tactile or by any of its providers for any service related to the use of the Website.

To stop receiving notifications, the User may manage their consents and preferences by directing a request to Scratch Jr Tactile with the User's telephone number and email address, or through the mechanisms enabled for this purpose in each communication. The User accepts that Scratch Jr Tactile sends a message to confirm that the request to unsubscribe from commercial communications has been received and attended to.

12. LEAVING THE COMMUNITY

The User may unsubscribe from the community by (i) following the procedure indicated in the same User account or (ii) by request via email toinfo@scratchjrtactile.org, indicating your username. Once the cancellation has been made effective to the User, Scratch Jr Tactile will send a confirmation of this. From then on, all features will no longer be available. 

In any case, the User may request a new registration, excepting the power of Scratch Jr Tactile not to admit said registration in cases in which the provisions of these Legal Texts are contravened. Likewise, Scratch Jr Tactile may not admit said registration in the event that the resolution of any conflict or controversy between the parties is pending.

13. CLAIMS

The User can file a claim by contacting Scratch Jr Tactile via emailinfo@scratchjrtactile.org, by postal mail or any other means of contact enabled on the Website or in theLegal warning.

14. JURISDICTION AND APPLICABLE LAW 

Given that the Website, with its included services, are intended to be used and offered in Spain, to the extent permitted by mandatory regulations, the applicable legislation will be Spanish common law. Any procedure related to the rights and obligations that may arise by virtue of, or in relation to, these Terms and Conditions will be submitted to the jurisdiction of the Courts and Tribunals of Barcelona.
